MODERN TEE TERMS AND CONDITIONS

These conditions are issued by Modern Tee:

When you register for the Modern Tee tee-shirt rating competition (the "Competition") you agree to be bound by the terms and conditions set out below. If you do not agree to these terms and conditions your registration will be invalid and you may not participate in the Competition.

  1. Voters in the Competition must be 16 years of age or above.
  2. You can rate the design using the rating system on the website. Your rating and any comments you submit on the design will be factors (but not the only factors) considered by the judges when determining the winner of the Competition. Any comments you submit may be passed to the designers, and may be used by Modern Tee in promoting or advertising future Competitions or the business operated through Modern Tee.
  3. The winning design will be selected on a regular basis by the judges selected by Modern Tee in its sole discretion. The criteria for a winning design will be assessed on a combination of factors including (but not limited to) the number of votes cast for each design, the rating of votes cast for each design and the comments made by voters for each design.
  4. The judges' decision on all matters relating to the winning design is final.
  5. By voting in the competition you warrant that no comments submitted by you to the Site will violate any right of any third party, including but not limited to their copyright, trademark, design right, privacy or other personal or proprietary right(s) whether registered or unregistered.
  6. You also warrant that no comments submitted by you to the voting site will be or contain defamatory or otherwise unlawful, abusive, offensive or obscene material.
  7. All comments are accepted in good faith and Modern Tee will not be deemed liable for any damages incurred to any third party by the publication of your comments.
  8. You are and shall remain solely responsible for the content of any comments you submit.
  9. You agree to indemnify Modern Tee and keep Modern Tee indemnified fully against any and all loss, injury, damage, costs or expenses incurred by Modern Tee as a direct or indirect consequence of your breach of these terms and conditions.
  10. If Modern Tee in their sole discretion find that these terms and conditions have been breached, Modern Tee may at any time withdraw from the site the comments submitted by you and delete your registration details from the site. Modern Tee shall be entitled to retain your details and refuse or cancel any subsequent registration requested or made by you.
  11. The designs submitted to the competition will be posted on the website for voting for a period set by Modern Tee in its sole discretion (normally of thirty five days but in some cases a shorter or longer period) during which time you will be able to register one vote per design.
  12. Multiple votes per design will not be permitted from any one e-mail address or customer number. You agree that you shall not whether alone or in concert with any other(s) attempt to manipulate the result of the Competition (whether by submitting multiple votes in the same Competition or by making multiple registrations or in any other way.) In the event that Modern Tee suspect that you have breached this condition, they shall be entitled to disregard votes cast by you and delete your registration details from the site. Modern Tee shall be entitled to retain your details and refuse or cancel any subsequent registration requested made by you.
  13. The winner of the competition will have his design printed on the Modern Tee shirt which will normally be available for sale the following month. If you have voted or are a registered member with Modern Tee you will be notified by email of the winning design and when the tee-shirt will be available for sale, and you agree that Modern Tee may retain your details and contact you for this purpose.
  14. You will be asked if you wish to provide biographical information about yourself and your contact details for publication on the website. This may include your name, email address, home address, biography and commentary on the designs. If you do provide biographical information and contact details you warrant that they are accurate and complete and give your express permission that they may be posted by Modern Tee on the website for a period of time determined by Modern Tee. Modern Tee shall be entitled to edit your biographical information and contact details.
  15. Your contact details will be used by Modern Tee to run the Competition, for the administration of sales of tee-shirts to you, and to provide you with details of goods and services provided by Modern Tee. Your biographical information may be used by Modern Tee for its own internal business planning purposes, and in promoting or advertising future Competitions or the business operated through Modern Tee. Modern Tee will not sell your biographical information or contact details to any third party.
  16. Modern Tee will not be held responsible for any problems arising from the provision or publication of these details or from contacting anyone via details provided on the web site.
  17. Except for any liability which cannot be excluded or limited under applicable law, Modern Tee, the judges and any other party involved in operating the Competition, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in delict (including without limitation negligence), contract or otherwise) in connection with the Competition in any way.
  18. The Competition and these terms and conditions shall be governed by and construed in accordance with U.S. law. Disputes arising in connection with the Competition and/or these terms and conditions shall be subject to the exclusive jurisdiction of the U.S. courts.

MODERN TEE.COM COMPETITION ENTRIES: LEGAL TERMS AND CONDITIONS

When you enter a design (the "Design") into the Modern Tee tee-shirt competition (the "Competition") you agree to be bound by the terms and conditions set out below. If you do not agree to these terms and conditions your entry will be invalid and you may not participate in the Competition.

  1. Entrants to the Competition must be 16 years of age or above. Modern Tee reserves the right to withdraw or cancel any entry by an entrant who cannot provide to Modern Tee suitable evidence of age in a form acceptable to Modern Tee.
  2. You may submit a Design for the Competition only by using the design template provided by Modern Tee (downloadable from the Modern Tee website) and by complying with the design rules and conventions set out on the website. Any failure to do so shall entitle Modern Tee to reject your entry which will not then be eligible to participate in the Competition.
  3. Unless Modern Tee determines otherwise, the Designs submitted to the Competition will be posted on the Modern Tee website for voting for a period set by Modern Tee in its sole discretion (normally of thirty five days but in some cases a shorter or longer period. ) Modern Tee is not obliged to accept any entry for the Competition, and may in its sole discretion reject any entry or withdraw it from the Competition at any time. Modern Tee shall be entitled to edit any comments submitted by you along with the Design.
  4. The winning design will be selected on a regular basis by the judges selected by Modern Tee in its sole discretion – depending on the timescale appropriate for the Competition. The criteria for a winning design will be assessed on a combination of factors including (but not limited to) the number of votes cast for each design, the rating of votes cast for each design and the comments made by voters for each design.
  5. The judges' decision on all matters relating to the winning design is final.
  6. The winner of the competition will have his design printed on the Modern Tee tee-shirt which will normally be available for sale the following month (or in such later month as Modern Tee deem appropriate).
  7. The winning designer will be notified by e-mail. The prize(s) payable to the winning designer will be clearly stated on the Modern Tee site in the section relating to the relevant Competition. Prizes may vary in Modern Tee discretion reserves the right to substitute prizes of equivalent nature and/or value for the prizes mentioned on the Modern Tee site. If the section of the Modern Tee site relating to the relevant Competition does not specify a particular prize, the following provisions shall apply:
      1. The winning designer will receive a prize of $300 payable by check or money order, two t-shirts with your winning design, one dollar ($1.00) per shirt sold of your winning design, payable in increments of $50.00 (and not to exceed $300.00 in any 30 day period), and a period of 12 months from the date that this form has been signed (we may exceed the period of 12 months at our discretion), and, if applicable, an additional $300.00 if Modern Tee re-prints your design for a different style of shirt (baby doll, v-neck, long sleeve, etc.) We reserve the right to change the guidelines (That includes Prize increase and or decrease any changes made will be posted here.)
  8. Modern Tee shall pay any sum due by check or money order payable to the name entered by the winning designer to the address submitted by him/her.
  9. If your Design wins the competition, you agree that your submission of that Design constitutes an assignation to Modern Tee of all Rights in that Design (the "winning Design"). Modern Tee will own exclusively all Rights and shall not be limited in any way in its use, for commercial or other purposes, of any winning Designs. All winning Designs shall become and remain Modern Tee property. However, if in time you wish to use the winning Design for commercial purposes yourself, Modern Tee will always act positively towards any proposal by you to use the winning Design for commercial purposes and act reasonably in negotiating an agreement on suitable terms for such use by you.
  10. For the purposes of these terms and conditions, "Rights" shall mean all rights, title and interest in and to any copyright, inventions, discoveries, trade names, trade marks (registered and unregistered) designs and design rights (registered and unregistered), badges of trade, get-up, and any other intellectual property rights of a cognate or similar nature arising anywhere in the world in the Design.
  11. You waive your whole moral rights in any winning Design of yours. You may however display or archive any winning Design in a portfolio or personal collection. Unless you have agreed otherwise (as mentioned in condition 9), you may not sell or reproduce the winning Design for commercial purposes (which would include but are not limited to selling or commercially licensing the winning Design or derivatives of the winning Design).
  12. By submitting a Design for the Competition, you agree that (whether or not that Design wins the Competition), Modern Tee may use that Design in promoting or advertising future Competitions or the business operated through Modern Tee, including but not limited to featuring it on Modern Tee and in any promotional emails, bulletins, leaflets, flyers, posters and/or other advertising or marketing materials. However, unless otherwise agreed with you Modern Tee shall not be entitled to sell any tee-shirts which feature that Design or make any other use of the Design except as set out in this condition.
  13. By entering the Competition you warrant that no Design or comments submitted by you to Modern Tee will violate any right of any third party, including but not limited to their copyright, trademark, design right, privacy or other personal or proprietary right(s) whether registered or unregistered and that the Design has not previously been submitted to any other competition. Any comments you submit may be used by Modern Tee in promoting or advertising future Competitions or the business operated through Modern Tee
  14. You warrant that:- (a) you are the owner of the Rights; (b) you have not created the Design as an employee in the course of your employment; (c) the Design is entirely your own original work; (d) you have full power and authority to enter into the Competition on these terms and conditions and have not assigned or granted a licence of the Rights to any third party; and (e) you shall do nothing to prejudice or threaten the validity of the Rights.
  15. You warrant that no comments or Designs submitted by you to the Competition will be or contain defamatory or otherwise unlawful, abusive, offensive or obscene material
  16. All Designs and comments are accepted in good faith and Modern Tee will not be deemed liable for any damages incurred to any third party by the publication or production of your design.
  17. You are and shall remain solely responsible for the content of any Designs or comments you submit.
  18. You agree to indemnify Modern Tee t and keep Modern Tee indemnified fully against any and all loss, injury, damage, costs or expenses incurred by Modern Tee as a direct or indirect consequence of your breach of these terms and conditions.
  19. If Modern Tee in their sole discretion find that these terms and conditions have been breached Modern Tee may at any time withdraw from the site the Design and/or comments submitted by you. In the event that a Design has been a winning design and prize money has been paid you shall immediately repay all such money to Modern Tee, which shall be entitled to take all appropriate steps to recover such money and you agree that you will be liable for any cost incurred in the production of the t-shirts and subsequent loss of sales. Modern Tee shall be entitled to retain your details and refuse or cancel any subsequent Competition entry made by you.
  20. You will be asked if you wish to provide biographical information about yourself and your contact details for publication on the Modern Tee website. If you do provide biographical information and contact details you warrant that they are accurate and complete and give your express permission that they may be posted by Modern Tee on the website for a period of time determined by Modern Tee. Modern Tee shall be entitled to edit your biographical information and contact details.
  21. MODERN TEE.COM SHOP: LEGAL TERMS AND CONDITIONS

  1. ORDER PROCESS
    • Find What You want to Buy Click on shop to view all designs currently available to buy. To get more info about each design, click on the design and there you will find:
      • a larger image of the design
      • colour and size availability
      • background info
      • the buttons you need to add the t-shirt to your Shopping Cart
    • Add it to your shopping cart The Shopping cart is where you keep items you wish to buy. Up until the point at which you submit your order (see 'Proceed to Checkout' below), You will still be able to delete t-shirts or save them for later if you change your mind. When you find what you want and have selected size and colour click "Add to Shopping Bag". When you have chosen everything that you want click "View Bag" in the top right hand corner of the home page. To start completing the order form click "Proceed to Checkout"
    • Proceed to Checkout At this stage you will be asked to complete the order form with your name and address details, delivery requirements and payment details. Only once you have completed the mandatory details and pressed send will the order be completed and submitted to us.
    • Acknowledgement of Order Acknowledgement that your order has been received and passed for processing will be sent to you by e-mail. Please check the order acknowledgement carefully. If the order details are incorrect or you have changed your mind please e-mail support@moderntee.com immediately. Please note receipt of order acknowledgement does not necessarily constitute or imply our acceptance of your order. Acceptance of your order and the formation of the contract between you and us will occur when we dispatch to you the products ordered, unless you have cancelled your order (see below) or we have notified you that we do not accept your order. Once your order is acknowledged you can normally expect your order to be accepted/dispatched within 3-5 working days. We will notify you if there is any delay or problems with the order. We may decline an order for any reason in our sole discretion, although if we do so we will email you to explain why.
    • Your order will be sent to you as soon as reasonably possible and will normally be within 3-5 working days from when acknowledgement of receipt of order is e-mailed to you. However should there be any unforeseeable delays you will be kept informed of a revised time of delivery and of course your right to cancel your order if the revised delivery time is unsuitable.

  3. OWNERSHIP AND RISK You will become the owner of the products ordered once they have been paid for in full and delivered to you. The risk of loss of or damage to these products becomes yours (once they have been delivered to you).
  4. DESCRIPTION, QUALITY AND COLOUR
    • 100% Cotton,fine jersey Tee's
    • The description of the products you order will be as shown on our website at the time you submit your order. We have made every effort to display as accurately as possible the colours of our products that appear on our Site. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.
    • Size Guide Sizes are approximate and for guidance only.

    • Refer to Label on the T-shirt for washing instructions.
      • We will not be liable to you for any defects in products arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, any failure by you to follow our recommendations for washing and ironing, or any alteration or repair carried out without our approval.
    • Nothing in these terms and conditions affects any statutory rights you have as a consumer.
    • Soft Hand Printed Tee's are more suseptible to Fibrilation (Little Hairs Standing up) we can not do anything about that. Soft Hand Printed Tee's Should be washed in luke warm water and Low Tumble or Hang Dried. (We can not accept returns on washed tee's)
  5. POSTAGE AND PACKING DELIVERY COSTS All T-shirts will be mailed out using First Class mail, 5-10 day shipping. It will take us 1-2 days to process your order and 5-10 days for your order to get to you. We do ship outside of the U.S. Please Email us for additional info.
    • OUR RETURNS POLICY We are sure that you will be very happy with your purchase. However, we will act promptly if the goods we send you are damaged, defective or incorrect.
    • Return of damaged, defective or incorrect goods
      • If the item was damaged in transit, if you take delivery of a package and the contents have been damaged in transit, you can return the item(s) to us within 30 days of receipt for exchange. Please contact us by e-mail support@moderntee.com, and we will llocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.
      • If the item is defective, you have the right to return a faulty item within 30 days. Please contact us by e-mail support@moderntee.com as soon as possible to inform us of your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.
      • If we mailed the wrong size or color, mail it back within 7 days of receipt for an exchange, please let us know what was wrong with it. We will reimburse you for your mailing fee's and send you a replacement tee with the correct size and or color.
      • Wrap the package carefully and send it back to us. Obtain delivery confirmation from the post office, as you are responsible for the package until we receive it returned safely into our warehouse.
      • It is your responsibility to meet the costs of returning the goods to us, and to take care that they are not damaged while in your care or in transit. If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods. If we have not yet refunded you (see below) we may deduct these costs before refunding the balance to you.
      • Any refund will be provided as soon as possible and at the latest within 30 days of us receiving the returned order. We will e-mail you to let you know that the returned item has been received.
      • Soft Hand Printed Tee's are more susceptible to Fibrilation (Little Hairs Standing up) its normal. Soft Hand Printed Tee's Should be washed in luke warm water and Low Tumble or Hang Dried. (We can not accept returns on washed tee's).
  6. DELIVERY PROBLEMS
    • If you haven't received an e-mail acknowledging your order, please contact us at support@moderntee.com quoting your order reference number.
    • If you have received an acknowledgement that your order has been received then your order is in the system and being processed. We will deliver your order to you from 5-10 days after receiving confirmation of acceptance of order. In the unlikely event of delivery problems at our end we will keep you informed by e-mail of expected dispatch dates. If more than 30 days have elapsed and you have not received an e-mail saying that your goods have been dispatched please contact us at support@moderntee.com
  7. If you have received e-mails confirming acknowledging that your order was received and an e-mail confirming that your order has been dispatched but you still have not received within 14 days. Email us and we will take care of the problem.
